HC registers PIL, seeks transparency in temple administration
Uttarakhand high court takes suo motu action over alleged mismanagement at Kainchi Dham temple

The Uttarakhand High Court has taken suo motu cognizance of alleged mismanagement at the famous Kainchi Dham temple in Nainital district. The court has registered a Public Interest Litigation (PIL) after a letter petition raised serious concerns about the temple’s administration, financial transparency and unregulated construction activities.
The matter was heard by a division bench comprising Chief Justice Manoj Kumar Gupta and Justice Subhash Upadhyay on Wednesday. The petition was submitted by Thakur Singh Dasila, a resident of Pithoragarh district, who alleged irregularities in the functioning of the temple trust and highlighted growing pressure on local infrastructure due to the rising number of devotees.
Concerns over management and transparency
According to the petition, there are serious concerns about how the temple is being managed. Dasila alleged that there is a lack of transparency in the financial dealings of the trust that runs the shrine. He claimed that the temple receives donations worth crores of rupees every year, but details about income, expenditure and audit reports are not made public.
The petitioner also raised questions about the identity and functioning of the trust managing the temple. He stated that important information such as the official name of the trust, its registration documents, office address, number of trustees and details of their appointments are not easily available to the public. He alleged that even basic records are not accessible through the administration or the registrar’s office.
Another major concern highlighted in the letter is the issue of foreign contributions. The temple attracts a large number of devotees from abroad. The petitioner has asked for clarity regarding foreign donations and cash contributions. He has demanded that audit reports and financial statements should be made public to ensure accountability.
In addition to financial matters, the petition also pointed to alleged unregulated construction activities in and around the temple premises. It claimed that construction work is taking place without proper planning or regulation, which could affect the environment and safety of visitors. The increasing footfall at the shrine, especially during peak seasons, has reportedly put heavy pressure on local roads, parking facilities and public services.
During the hearing, Chief Standing Counsel for the state, C.S. Rawat, presented instructions received from the district magistrate of Nainital. The court noted that a communication from the secretary and member trustee of the Shri Kainchi Hanuman Mandir and Ashram denied all the allegations made in the letter petition. The trust described the claims as false and baseless.
However, in order to ensure a fair hearing, the court allowed the Shri Kainchi Hanuman Mandir Trust to be impleaded as a respondent in the case. The bench also issued a formal notice to the petitioner and appointed advocate Dharmendra Barthwal as amicus curiae to assist the court in the matter.
The high court has directed that necessary instructions be obtained from the district magistrate of Nainital to facilitate the judicial process. The next hearing in the case has been scheduled for March 18.

Temple’s spiritual legacy and growing footfall
Kainchi Dham is one of the most famous spiritual centres in Uttarakhand. The ashram was founded on June 15, 1964, by Neem Karoli Baba, who is also popularly known as Maharaj-ji. He was a devoted follower of Lord Hanuman and is widely respected by his followers in India and abroad.
The temple is located in the Bhowali area of Nainital district, along the banks of the Shipra River. Over the years, it has become a major pilgrimage site, drawing lakhs of devotees annually. Many visitors believe in the spiritual power and teachings of Neem Karoli Baba, and they visit the ashram to seek blessings and peace.
The popularity of Kainchi Dham has grown rapidly in recent years. Improved road connectivity, social media exposure and the global interest in Indian spirituality have led to a steady rise in visitors. During special occasions and anniversaries, thousands of devotees gather at the shrine, leading to heavy traffic and crowd management challenges.
With the increasing number of visitors, concerns have also grown about infrastructure, waste management and environmental protection in the area. Local residents have often raised issues about traffic jams, lack of parking space and strain on basic facilities such as water and sanitation.
The high court’s decision to take suo motu cognizance reflects the seriousness of the concerns raised. By registering a PIL on its own, the court has shown that it considers the matter to be of public importance. The court’s intervention is expected to bring clarity to the allegations and ensure that proper systems are in place for transparent administration.
At the same time, the temple trust has denied all allegations and is likely to present its side during the upcoming hearings. The court will examine documents and hear arguments from all parties before making any observations or issuing directions.
The case has drawn attention from devotees, local residents and observers across the state. Many believe that better transparency and proper planning can help protect the spiritual heritage of Kainchi Dham while also ensuring that the growing number of visitors does not harm the environment or local community.
As the matter comes up for hearing on March 18, all eyes will be on the Uttarakhand High Court. The outcome could lead to important guidelines on the management of religious institutions and public accountability in the state.
